Terms of use

The short version: Kelikello is licensed to you under Apple’s standard terms, the weather comes from FMI as-is, and it is not a warning service. The details follow.

Your licence

Kelikello is licensed to you, not sold, under Apple’s Standard Licensed Application End User License Agreement (the “Standard EULA”). The licensor is The Hangover Company (“we”).

The terms on this page add details the Standard EULA does not cover: how the weather information should be used, where it comes from, and who to contact. If anything here conflicts with the Standard EULA, the Standard EULA prevails.

Weather information

Forecasts and observations in Kelikello come from the Finnish Meteorological Institute’s open data service and are shown as provided. Weather forecasts are predictions: they can be inaccurate, they can change quickly, and the data can be delayed or temporarily unavailable. The nearest-station observation is a measurement at a station that may be some distance from you.

We work to show FMI’s data faithfully and keep the app working, but we cannot promise that the information is complete, accurate or current at every moment.

Not for safety-critical use

Kelikello is not an official warning service. For weather warnings, use FMI’s official warnings and follow the instructions of the authorities.

Do not rely on Kelikello for decisions where an error could put people or property at risk, such as boating or other activity at sea, trips in the fells or wilderness, aviation or drone flights, or work that depends on weather conditions. For those, use the official forecasts, warnings and services made for that purpose.

Kelikello is an independent app by The Hangover Company. It is not affiliated with, endorsed by or sponsored by the Finnish Meteorological Institute, and FMI is not responsible for the app. Questions about the app go to us, not to FMI.

Availability and updates

Kelikello depends on FMI’s open data service and on watchOS, neither of which we control. If FMI changes or suspends its service, parts of the app may stop working until we can adapt it. We may release updates to fix problems, keep the app compatible or improve it. Updates are free through the App Store.

Your rights under consumer law regarding digital content, including the right to receive updates needed to keep the app in conformity, are not affected by this section.

Purchases and refunds

Kelikello is a one-time purchase on the App Store with no in-app purchases or subscription. Apple sells the app on our behalf and handles payment and refunds. See Purchases and refunds.

Liability

To the extent permitted by applicable law, we are not liable for indirect or consequential loss, or for loss arising from reliance on weather information shown in the app, including where that information turned out to be inaccurate, delayed or unavailable.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intentional misconduct or gross negligence, and nothing in these terms limits the mandatory rights you have as a consumer under the law of the country where you live.

Governing law and disputes

If you are a consumer, the mandatory consumer-protection rules of the country where you live always apply, and you may bring a claim in the courts of that country.

If something goes wrong, please contact us first; most problems can be sorted out by email.

Changes to these terms

We may update these terms, for example when the app gains features. We will change the effective date at the top of this page. Changes do not take away rights you already have for a purchase you made.
